Terms of Service

These Terms of Service ("Terms") govern the use of the OBS2GO cloud enterprise resource planning platform ("Service") provided by OPEN BUSINESS SOLUTIONS EOOD, a company registered in Bulgaria ("Provider", "OBS2GO", "we", "us").

By accessing or using the Service, the customer ("Customer", "you") agrees to be bound by these Terms.


1. Definitions

Service
The OBS2GO cloud ERP platform, including all related applications, APIs, and services.

Customer Data
All data uploaded, entered, or generated by the Customer within the Service.

Subscription
The paid access plan that grants the Customer the right to use the Service.

Authorized Users
Employees or representatives of the Customer authorized to access the Service.


2. Service Description

OBS2GO provides a cloud-based ERP platform that enables businesses to manage operations including but not limited to:

  • accounting

  • logistics

  • inventory

  • finance

  • reporting

  • operational workflows

The Service is provided via internet access and hosted infrastructure.

OBS2GO may update or improve the Service at any time provided such updates do not materially reduce core functionality.


3. Customer Accounts

Customers must create an account to access the Service.

The Customer agrees to:

  • provide accurate information

  • maintain confidentiality of login credentials

  • ensure only authorized users access the system

The Customer is responsible for all activities conducted through its accounts.

OBS2GO may suspend accounts in case of suspected unauthorized use or security risks.


4. Subscription and Fees

Access to the Service requires an active subscription.

Customers agree to:

  • pay all applicable subscription fees

  • maintain valid payment information

  • comply with billing terms specified in their subscription plan

Subscriptions renew automatically unless cancelled prior to the renewal date.

OBS2GO reserves the right to change pricing with at least 30 days prior notice.

Failure to pay may result in suspension or termination of the Service.


5. Acceptable Use

Customers agree not to:

  • use the Service for unlawful activities

  • attempt to gain unauthorized access to systems

  • reverse engineer or copy the software

  • disrupt the Service or infrastructure

  • upload malicious code or malware

Violation may result in suspension or termination.


6. Customer Data Ownership

The Customer retains full ownership of all Customer Data stored within the Service.

OBS2GO acts solely as a data processor and processes Customer Data only to provide the Service.

OBS2GO does not claim ownership of Customer Data.

Customers are responsible for ensuring they have legal rights to all data uploaded to the Service.


7. Data Security

OBS2GO implements commercially reasonable technical and organizational measures to protect Customer Data, including:

  • encryption of data in transit (TLS)

  • secure infrastructure

  • regular system updates

  • access controls

  • monitored hosting environments

While OBS2GO takes reasonable precautions, no system can guarantee absolute security.


8. Backups

OBS2GO performs regular backups of the Service infrastructure.

However, Customers remain responsible for maintaining their own copies of critical data where necessary.

OBS2GO is not liable for loss of data caused by:

  • user error

  • third-party integrations

  • force majeure events


9. Service Availability (SLA)

OBS2GO will use commercially reasonable efforts to maintain 99.5% monthly uptime excluding:

  • scheduled maintenance

  • emergency maintenance

  • force majeure events

  • internet service disruptions outside OBS2GO control

Scheduled maintenance will be communicated in advance whenever possible.


10. Support

OBS2GO provides technical support through available support channels.

Typical response targets:

Priority Response Time
Critical system outage within 4 hours
Major issue within 1 business day
General inquiry within 10 business days

Support may be provided via email, ticket system, or other support channels.


11. Data Export and Portability

Customers may export their data from the Service using available export tools.

Upon termination of the subscription:

  • data will remain available for 30 days

  • customers may request a full export

After this period, data may be permanently deleted.


12. Intellectual Property

All rights, title, and interest in the Service, including software, design, and intellectual property, remain the exclusive property of OBS2GO.

These Terms grant the Customer a limited, non-exclusive, non-transferable license to use the Service during an active subscription.

Customers may not:

  • copy

  • distribute

  • sublicense

  • modify the software.


13. Third-Party Services

The Service may integrate with third-party services.

OBS2GO is not responsible for:

  • availability of such services

  • changes made by third-party providers

  • data handling practices of external systems.


14. Limitation of Liability

To the maximum extent permitted by law:

OBS2GO shall not be liable for:

  • indirect damages

  • loss of profits

  • loss of business

  • loss of data

  • business interruption

Total liability shall not exceed the fees paid by the Customer during the preceding 12 months.


15. Termination

Either party may terminate the subscription:

  • at the end of the billing period

  • for material breach of these Terms

OBS2GO may suspend or terminate accounts for:

  • violation of these Terms

  • illegal activity

  • security threats

  • non-payment


16. Data Deletion

Upon termination of the Service:

  • Customer data will be retained for 30 days

  • after which it may be permanently deleted

Customers are responsible for exporting their data before deletion.


17. Privacy and Data Protection

OBS2GO processes personal data in accordance with:

  • EU General Data Protection Regulation (GDPR)

  • applicable Bulgarian data protection laws

Further details are provided in the Privacy Policy and Data Processing Agreement (DPA).


18. Force Majeure

OBS2GO shall not be liable for failure or delay caused by events beyond reasonable control including:

  • natural disasters

  • war

  • cyber attacks

  • infrastructure outages

  • government actions

  • internet failures


19. Governing Law

These Terms shall be governed by the laws of the Republic of Bulgaria.

Any disputes shall be subject to the jurisdiction of the courts of Sofia, Bulgaria.


20. Changes to Terms

OBS2GO may update these Terms periodically.

Customers will be notified of material changes.

Continued use of the Service after updates constitutes acceptance of the revised Terms.
